Anyone who wishes to engage in alcohol prevention needs to be acquainted with the legislative and liability context in which licenced establishments as described in the Liquor Licence Act, operate. If a consultant understands this context, the prevention policies and other initiatives that are developed will be consistent with existing laws and will anticipate and give direction to prevent potential liability. The government of Ontario has initiated a process, inviting the people of Ontario to propose changes to the Liquor Licence Act (LLA). Depending on which side of the act one represents, proposals might fall into two major silos. In one silo there will be those who propose less restrictions on the service of alcohol, reduced consequences for infractions and greater access to alcohol in general. On the other side, the public health silo, there be those who will note the risks to public health associated enhanced access and will advocate for increased enforcement of the law that is currently on the books (e.g., not serving minors, not serving to intoxication, not serving those who are intoxicated, etc.) See the CAMH Retail Monopolies Best Advice statement. New statutes (e.g., making it illegal to allow/permit underage drinking) can be proposed.
